When the owner dies, the house becomes a formula.

English probate and Islamic faraid will fight over the same terrace unless you write both into the plan while you are alive. An HPP does not disappear at the janazah.

Faraid assigns fixed shares: spouse, children, parents, in ratios the Quran states. English law assigns whatever the will and the 1975 Act say, or intestacy. A Muslim who owns 40% of a diminishing musharakah and leaves ‘everything to my wife’ has written an English sentence on top of a divine one.

What to do in this country

A will that directs executors to distribute the estate according to the Shariah, drafted by someone who has done it, is the usual UK tool. It is not perfect. It is better than silence. Tell the Islamic bank how they treat death: unit purchase by the estate, sale of the house, surviving co-owner rights. Write the shares down. Do not assume the remaining 60% ‘just goes to the bank’ without reading.
